Between Mallorca Women’s Tournament, hereinafter referred to as “The Tournament”, and the participants, hereinafter referred to as “The Participant”, the following agreement is established with respect to warranty and image transfer rights:
1. Warranty:
The Participant represents and warrants that he/she has full right, power and authority to grant the image release rights in accordance with the terms of this document. You warrant that you own all necessary rights to your image, voice and any other intellectual property associated with your participation in The Tournament.
2. Assignment of Image:
The Participant grants The Tournament, irrevocably and without restriction, the right and authorization to use his/her image, name, voice, photographs, videos and any other representation of his/her person during his/her participation in The Tournament, for promotional, advertising, broadcasting and commercial purposes related to The Tournament, whether in print, digital or any other form, worldwide and for as long as necessary to fulfill such purposes.
3. Consent:
The Participant expressly consents to The Tournament’s use of his or her image and other rights granted herein without further approval or notice, and waives any moral rights he or she may have with respect to his or her image or participation in The Tournament.
4. Compensation:
The Participant acknowledges and agrees that he/she will not receive any financial compensation for the assignment of the image rights and other rights contemplated herein, and that his/her participation in The Tournament is on a voluntary basis and without expectation of additional remuneration.
5. Indemnification:
The Participant agrees to indemnify and hold harmless The Tournament, as well as its affiliates, officers, directors, employees and agents, from any claim, demand, loss, liability or expense arising out of or related to any breach by the Participant of the warranties or provisions set forth herein.
6. Validity:
This agreement shall remain in effect for the period during which The Participant participates in The Tournament and shall continue to be valid and binding even after the conclusion of his/her participation in The Tournament.
7. Applicable Law:
This agreement shall be governed by and construed in accordance with the laws of Spain and any dispute arising in connection with this agreement shall be settled exclusively by arbitration in accordance with the arbitration rules in force in Spain, seated in Palma de Mallorca and the language of arbitration shall be Spanish.
